Privacy and Cookie Policy

1.         Introduction

1.    This Privacy Policy sets out the privacy and cookies policy of CLR CODE LIMITED, a company registered in England and Wales, (and with a branch office in Germany at Alte Ziegelei 2-4, 51491, Overath, Germany) with registration number 10411689, a “data controller” for the purpose of the German Federal Data Protection Act (“BDSG”); and the following who act as “data processors” on behalf of CLR Code within the meaning of the BDSG: Ascential Group Limited, WGSN Ltd, WGSN Inc, WGSN GmbH and Fiege Logistik Stiftung & Co. KG (the foregoing together with CLR Code Limited hereinafter referred to as “CLR Code”).

2.    CLR Code collects and uses your personal data strictly within the legal limits of the data protection laws of the Federal Republic of Germany. CLR Code is committed to protecting the privacy of its users and the purpose of this Privacy Policy is to describe to you how CLR Code will use personal data about you that is submitted to CLR Code.

3.    If at any time you wish to change the uses of your personal data, please contact us at contact@coloro.com.

4.    CLR Code may revise this Privacy Policy at any time by posting an update on its website(s). Please ensure that you check this website and any other CLR Code website(s) you use from time to time to review the then current Privacy Policy and to update your preferences. This Privacy and Cookies Policy was last updated in May 2017.

2.         Collection of Personal Data

1.    Data protection concerns personal data. This is defined in Sec. 3 para. 1 of the BDSG as any information concerning the personal and material circumstances of an identified or identifiable individual. This includes information like name, postal address, e-mail address or telephone number, but also usage date in some cases. Usage data are data required to use our website, for instance information about start, end and extent of website use as well as login data.

2.    CLR Code (or any of its sub-contractors processing such personal data on CLR Code’s behalf) may collect personal data about you in the following ways:

a.    any data which you provide when you complete and submit an application to CLR Code to register on its website(s) or receive email alerts or other communications from CLR Code;

b.    during any transaction with us;

c.     through calls made to or from CLR Code (including by way of conference call facilities) which may be recorded for quality and training purposes; and

d.    any other data which you provide to CLR Code when you enquire about our activities, email, telephone or write to us or otherwise provide us with personal data.

3.         Storage and retention of your Personal Data

1.    CLR Code will keep your personal data on a secure server. The technology that CLR Code uses and the security policies which CLR Code has implemented are intended to safeguard your personal data from unauthorised access and improper use.

2.    CLR Code will keep your personal data (to the extent permitted by the BDSG) to enable CLR Code to use it for the purposes described in this Privacy Policy.

4.         Use of Your Personal Data

1.    CLR Code may use your personal data (subject in each case to the requirements of the BDSG) for the following purposes:

a.    administering your website account(s) and otherwise in connection with any service for which you have provided your personal data, including any email alerts and transactions with us;

b.    responding to any enquiry you make;

c.     sending you newsletters and/or alerts and information regarding CLR Code’s future services (in all formats to which been made aware e.g. post, email, text);

d.    for generating aggregated statistics about users, traffic patterns etc. of the CLR Code website(s) and other services and developing CLR Code’s marketing plans using pseudonymous information; and

e.    subject to your consent, sending you newsletters and/or alerts and information regarding third party’s future services (in all formats to which you have consented e.g. post, email, text).

2.    CLR Code may also disclose your personal data (subject in each case to the requirements of the BDSG) as follows:

a.    if you have given your consent for CLR Code to do so, to other selected organisations to enable them to contact you or send you information by post, telephone and/or email;

b.    to any service providers, sub-contractors and agents appointed by CLR Code to perform the above functions on its behalf and in accordance with its instructions and where required under German data protection law only with your prior consent;

c.     to third parties selected by CLR Code as part of aggregated and anonymised statistics about users, traffic patterns etc. of the CLR Code website(s);

d.    to such individuals and/or bodies as necessary to ensure CLR Code’s compliance with any applicable law, regulation, legal proceeding or governmental request; and

e.    to any legally entitled individual making a subject information request to CLR Code pursuant to Sec. 34 para. 1 BDSG and Clause 11 of this Privacy Policy.

3.    In the event that CLR Code (or a relevant part of CLR Code) is acquired by or merges with another company, your personal data may be passed to the purchasing/merging company amongst the transferred business assets. This will enable your relationship to continue with the relevant CLR Code business despite the change of ownership. Your personal data may also be passed (on a confidential basis) to companies with whom CLR Code is negotiating such a sale/merger as part of the verification exercise carried out on CLR Code by the third party. In each case of a transfer of personal data to third parties to the extent described above, CLR Code will make sure that such transfer is made in accordance with this Privacy Policy and applicable data protection law.

In processing your personal data in accordance with the above, CLR Code may (to the extent permitted by the BDSG) send it outside the European Economic Area (“EEA”). CLR Code will take all reasonable steps to comply with applicable legal requirements providing adequate protection for the transfer of personal information to countries outside of the EEA or Switzerland and to make sure that in such circumstances your data is treated securely and in accordance with this Privacy Policy but your attention is drawn to the fact that the laws of countries outside the EEA may provide lesser protection to your personal data than Germany. If you are located in the EEA or Switzerland, CLR Code complies with applicable legal requirements providing adequate protection for the transfer of personal data to countries outside of the EEA or Switzerland.

5.     Cookies

When you visit a CLR Code website(s), CLR Code uses “cookie” technology try to make that experience simple, personalised and meaningful. Cookies are small pieces of information which are issued to your computer or any similar device you use to access the internet e.g. smart phone, tablet or other mobile device when you visit a website and which store and sometimes track information about you’re use of the website. A number of cookies CLR Code use last only for the duration of your web session and expire when you close your browser. Other cookies are used to remember you when you return to the website and will last for longer.

CLR Code use cookies to:

1.             create a specific log-in session for a visitor to a CLR Code website in order that page requests by that visitor are delivered in an effective, secure and consistent manner;

7.             Some of the cookies used by CLR Code websites are set by us, and some are set by third parties who are delivering services on our behalf. 6.    Clear GIFs

Clear GIFs (also referred to as “Web Beacons”) are used in conjunction with Cookies to give website operators a clearer understanding of the interaction of visitors with our website. A Clear GIF is a transparent graphic file used on a website. Using a Clear GIF enables the website to measure activities of a user opening the page containing the Clear GIF. CLR Code measures visitor conduct with Clear GIFs in order to improve visitor experience and facilitate administration of content. We may use Clear GIFs on this website, in our e-mails or our advertisements on other websites or in third party e-mails.

7.    Google Analytics

CLR Code uses Google Analytics (“Google Analytics”), a web analytics service provided by Google Inc. („Google“). Google Analytics uses so-called “cookies”. “Cookies” are text files that are stored on your computer and permit an analysis of your use of the website. The information about your website use generated by the Cookie (including your truncated IP address) is transmitted to a server controlled by Google in the USA and is stored there. Google uses this information to analyse your use of the website, to generate reports about website activities for website operators and to provide further services related to website and internet use. Google may also share such information with third parties to the extent it is legally required to do so and/or to the extent third parties process data on behalf of Google.

Disable Google Analytics

8.    Piwik

This website uses Piwik, an open source software for analysis of visitor statistics (“Piwik”). Piwik uses cookies. For this purpose, the usage information generated by the cookie (including your truncated IP address) is transmitted to our server and stored for the purpose of usage analysis in order to optimize our website. Your IP address is instantly anonymized in this process, so that you as a use stay anonymous to us. The information generated by the cookie regarding your use is not shared with any third party.

If you do not agree to the storage and analysis of these data resulting from your visit, you may opt out of the storage and use by clicking the link below. In this case, a so-called opt out cookie is stored in your browser, which will cause Piwik to not collect any session data. Please note that if you delete your Cookies, this will also delete the opt out cookie and you may have to activate it again.

9.  Registration

    1. To access certain parts of the CLR Code websites, CLR Code may require you to register and provide certain information about yourself.

    2. You are reminded that in addition to the provisions of this Privacy and Cookies Policy, where you register you also agree to:

a)    provide true, accurate, current and complete information about yourself as prompted by the relevant registration form (such information being the “Registration Data”); and

b)    maintain and promptly update the Registration Data to keep it fully up to date.

10.        Deletion of your data

To the extent your data is no longer required for the aforementioned purposes, it is deleted. To the extent data must be retained for legal reasons, they are blocked and will not be available for use.

11. Right to access and correction

Of course you are entitled, upon request, to disclosure regarding your personal data that CLR Code is storing. You are also entitled to have any incorrect data corrected and rights to blocking or deletion. 12.     Governing Law

This Privacy Policy is governed by, and will be construed in accordance with German law and the courts of Cologne shall have exclusive jurisdiction
